Lamiac wolnosci cywilne obywateli kanadyjskich i podwazajac suwerennosc panstwowa Kanady.

RCMP may have overstepped: Pivot

JEFF HODSON

Canada's auditor general needs to examine whether the RCMP had gone beyond their mandate when it funded academic critiques of Vancouver's supervised injection site, the Pivot Legal Society said yesterday.
The RCMP said the literature reviews were standard "due diligence" research, no different than research into traffic services or organized crime.
In a complaint to Auditor General Sheila Fraser, Pivot argued that spending money on crime prevention is within the RCMP's mandate. But, the group said, using public funds to research a public health matter, like harm reduction, is not.
"The RCMP was created as a police force and not to act as scientists," said Douglas King, a Pivot lawyer. RCMP Const. Annie Linteau agreed the RCMP are not "academic researchers" (METRO, Thursday, October 9, 2008).

N.S. court throws out drug convictions

Nova Scotia's Court of Appeal has quashed drug convictions against a dozen people because an RCMP officer fabricated evidence against them.
In a decision released yesterday, the court says all of the convictions cannot stand because former Mountie Daniel Ryan sold drugs while lying under oath to justify search warrants for the premises of the 12 men who were convicted.
"While investigating the appellants for drug-related offences, then RCMP officer Daniel Ryan kept a dark secret," the court says in its decision. "In fact he was a drug dealer, breaking the very laws that he was sworn to uphold."
The court says the rights of the men to fair trials were infringed. "Consider this. We have a police officer selling drugs while laying under oath to justify warrants to search the appellants' premises. For this reason alone, nothing short of a stay can serve to protect the integrity of our criminal justice system."
The Crown supported the appeals against the convictions. In every case, the men had pleaded guilty to the charges against them. Ryan was sentenced to four years in prison after he was convicted in June 2004 of marijuana trafficking.
