Taser didn't cause airport death: Crown

A Polish immigrant who died at Vancouver airport last year after being jolted five times by an RCMP Taser was a panicked alcoholic possibly in a state of delirium at the time, according to a review by Crown prosecutors.
Robert Dziekanski's death was not directly caused by the Taser jolts but they were one of several contributing factors, along with heart disease, alcohol withdrawal, the stress of being restrained and a decreased ability to breathe due to an officer kneeling on him, said Stan Lowe, spokesman for the B.C. Criminal Justice Branch.
Autopsy results revealed for the first time Friday found Dziekanski, 40, died because his heart stopped.
A forensic pathologist classified it as "sudden death following restraint," Lowe said, a cause of death that predates the use of Tasers.
The four Mounties who confronted Dziekanski won't face charges in his Oct. 14, 2007, death, Lowe announced. "There is a substantial body of independent evidence which supports that the officers in question were lawfully engaged in their duties when they encountered Mr. Dziekanski and the force they used to subdue and restrain him was reasonable and necessary in all the circumstances," Lowe told reporters.
He said the evidence "falls markedly short" of justifying charges.
Lowe said a use-of-force expert from another police department concluded the officers followed RCMP policy on the use of force. But while they're not criminally culpable, their actions played a part in the death, Lowe said.

Po szesciu miesiacach dochodzenia, Prokurator Generalny Kolumbii Brytyjskiej uznal, ze ich zachowanie nie nosilo cech przestepstwa kryminalnego.
Dziekanski, po 14-godzinnym locie i 10 godzinach na lotnisku, byl zdezorientowany i wycienczony. Jego matka dowiedziala sie, ze syn nie przylecial i odjechala do domu w Kamloops.
Czterej policjanci RCMP, wezwani na miejsce, po niecalej minucie razili Dziekanskiego co najmniej dwukrotnie taserem, co spowodowalo jego smierc.

No charges for RCMP officers in Taser incident
VANCOUVER * The case against four RCMP officers involved in the death of a man who was Tasered five times in October 2007 at the Vancouver International Airport "falls short" of the standards by which conviction is likely, the Crown announced yesterday.
As a result, none of them will be charged in the death of Robert Dziekanski, 40, who arrived in Vancouver after 21 hours of travelling, and died of cardiac arrest. Mr. Dziekanski exhibited bizarre, aggressive behaviour at the airport before being hit five times with a Taser, said Stan Lowe, speaking on behalf of the Criminal Justice Branch which oversees charges and prosecutions in B.C.
"The officers attempted to talk to Mr. Dziekanski and communicate with him with hand signals for several seconds," Mr. Lowe said. "He momentarily calmed down and dropped his arms to his side."
But then Mr. Dziekanski threw up his arms, grabbed a stapler and held it out in his hand, Mr. Lowe said. That's when Mr. Dziekanski was zapped with the Taser, he said. His cause of death was listed as "sudden death following restraint."
While the efforts of police to restrain the man were found to be a contributing factor in his death, the police actions were found to be reasonable under the circumstances, Mr. Lowe said. The officers involved were identified as Constable Kwesi Millington, Corporal Benjamin Monty Robinson and Constables Bentley and Rundel, whose first names were not released.
Const. Millington, the officer with the Taser, has since been redeployed to the Toronto West RCMP detachment.
